Platinum Prestige Care Plan Terms & Conditions

Welcome to Dream Room Theaters. These Terms and Conditions ("Terms") govern your access to and use of our website, services, and any interactions you may have with our brand online or offline. By using our site or services, you agree to these Terms in full.
1. Coverage Overview
The Platinum Prestige Care Plan ("Plan") is a premium, customizable warranty and maintenance service providing:
- •Comprehensive Craftsmanship & Manufacturing Protection
- •Unlimited Technical Support within business hours
- •White Glove Maintenance & Care
- •Full Replacement Coverage
- •Technology Upgrade Assurance Program
- •VIP Customer Experience, including same-day repairs (subject to product availability)
This Plan is tailored to each client's bespoke home theater system—components such as speakers, concession stands, custom chairs, projectors, control systems, décor, lighting, and other additions influence the scope and final pricing, which begins at $18,000/year but may increase based on customization.
2. Customization & Pricing
- •The final Plan includes warranty coverage only for the client's specific installed system.
- •Any upgrades or additions beyond the original scope (e.g., enhanced AV systems, luxury seating, concession setups) may increase the annual fee accordingly.
3. Warranty Timelines & Delays
- •Standard service includes quarterly on-site inspections, preventive maintenance, and performance optimization.
- •Replacement parts or components may experience delays due to manufacturing, shipping, or supply chain constraints. Dreamroom Theaters will provide timely updates and work to secure expedited replacements where feasible.
4. What's Not Covered / Exclusions
This Plan does not cover:
- •Intentional or wilful damage, misuse, neglect, modification by the client or third parties;
- •Normal wear and tear due to daily use;
- •Damage resulting from improper maintenance or unauthorized alterations;
- •Items already covered under third-party or manufacturer warranties, beyond facilitation;
- •Consequential, indirect, or incidental damages (e.g., lost enjoyment, business interruption);
- •Delays or services rendered under force majeure events, supply chain interruptions, or vendor restrictions;
- •Environmental or structural issues, including humidity, mold, water leaks, electrical surges, pests, or foundation shifting;
- •Pre-existing conditions in the home (walls, ceilings, electrical, HVAC, plumbing) not caused by Dreamroom Theaters;
- •Furniture & décor damage caused by stains, fading, pets, scratches, or cosmetic wear and tear;
- •Third-party components or integrations not supplied and installed by Dreamroom Theaters.
5. Client Responsibilities
Clients must:
- •Maintain appropriate climate control (temperature & humidity).
- •Use surge protection and/or an uninterrupted power supply (UPS) for critical equipment.
- •Follow provided care and cleaning guidelines.
- •Provide reasonable access to the home theater room for service appointments.
Failure to do so may void coverage.
6. Ontario & Canadian Legal Protections
- •Under Canadian and Ontario law (Consumer Protection Act), services must meet reasonably acceptable quality. Contracts may be subject to a 10% over-estimate rule without consent.
- •Renovation or craftsmanship services in Ontario do not carry statutory minimum warranty periods unless specified in writing. New home warranties (Tarion) do not apply.
- •Written change orders are required for amendments to the original service scope.
- •Explicit warranties like this Plan override implied warranties, but still exist in addition to consumer protection rights.
7. Service Terms & Obligations
- •Quarterly Maintenance Visits: Deep cleaning (screens, projector lenses, acoustic surfaces), furniture care, lighting/speaker dusting, and system calibration.
- •24/7 Technical Support & Remote Diagnostics: Available via phone or web chat.
- •VIP Customer Experience: One dedicated account manager, access to showroom previews, and same-day repair scheduling depending on component availability.
- •Full Replacement: Defective components—projectors, audio processors, chairs, lighting fixtures, etc.—are replaced with equivalent or upgraded units, subject to availability.
- •Upgrade Assurance Program: Annual technology review and optional upgrade recommendations, with associated costs outlined separately.
8. Product Availability Limitation
If a product model is discontinued or unavailable, replacements will be of equivalent quality or an upgraded model, at Dreamroom Theaters' discretion.
9. Claims Process & Assessment
- •Clients must report issues in writing (email acceptable) within 14 days of discovery.
- •Dreamroom Theaters will assess damage and determine coverage applicability. If coverage applies, service or replacement will be scheduled promptly.
- •If assessment reveals exclusions (e.g., client-caused damage), an estimate for repair or replacement will be provided for client approval.
10. Limitation of Liability
Dreamroom Theaters' liability is limited to repair or replacement costs under the Plan. The company is not liable for indirect damages or losses, including business interruption, enjoyment loss, or other consequential costs.
11. Term & Renewal
- •The Plan is valid for one year from the effective date, renewable annually with terms and pricing subject to review.
- •Any additions or system changes require a written amendment to the Plan (change order).
12. Governing Law & Dispute Resolution
- •These Terms are governed by the laws of Ontario and Canada.
- •Disputes shall be resolved through amicable negotiation or, if necessary, through mediation or binding arbitration in Ontario.
13. Client Acknowledgment
By subscribing to the Platinum Prestige Care Plan, the client acknowledges:
- •Understanding of the scope, exclusions, timelines, and pricing structure.
- •That coverage is exclusive to the client's bespoke theater system and may vary.
- •That any modifications or damage outside permitted uses may incur additional fees.
14. Entire Agreement
This document, along with the client-specific schedule and change orders, constitutes the entire agreement regarding the Plan. It supersedes any prior proposals or representations.
